Terms and Conditions of Dewar’s Aberfeldy Distillery’s Collector’s Club

Dewar’s Aberfeldy Distillery Collector’s Club enables you to collect points with every purchase, on-site and online, and use these points to earn money-off your favourite whisky items and gifts commencing the date you sign up to join. Depending on the membership you join*, you may also receive access to a variety of extra benefits which can be changed or removed at our discretion. Any changes will be of equal or increased value. To use your loyalty card and earn points, simply swipe your card at our till when making a purchase in our distillery shop, café or whisky bar. If you want to collect points on our online store, just tick the loyalty member option at the cart stage and we will add your points automatically. Please bring Photo I.D with you each time you use your loyalty card on-site. This allows us to verify your identity where necessary and ensures the card cannot be used by anyone other than the authorised holder. Members of the Collector’s Club must be 18 years or over. The loyalty card can only be used the authorised holder. Dewar’s Aberfeldy Distillery, in its absolute discretion, reserves the right to end the Collector’s Club and to remove or change any of the benefits and perks associated with the loyalty scheme for any reason including, but not limited to technical, health and safety and/or operational reasons. All Collector’s Club cards remain the property of Dewar’s Aberfeldy Distillery and can be withdrawn at any time. Collector’s Club cards can be purchased as gifts for third party participants, on the condition that the card is ordered with the name, D.O.B, and address of the third party in the appropriate space on the sign-up form. Collector’s Club cards are otherwise are non-transferable and non-refundable, and cannot be sold, loaned or used by a third party. Access may be denied to the visitor centre in the event of fraud or misuse of the Collector’s Club card, and the Collector’s Clubcard can be withdrawn from any person whose conduct is deemed to be inappropriate in the absolute discretion of Dewar’s Aberfeldy Distillery. Inappropriate conduct includes, but is not limited to, allowing or assisting a third party to attempt to gain unauthorised or improper access to the visitor centre with a Collector’s Club card of which they are not the valid holder. Collector’s Club cards can be used in conjunction with any promotional offer, voucher or incentive Lost Collector’s Club cards should be reported to Dewar’s Aberfeldy Distillery immediately. Contact CollectorsClub@dewars.com in the event of a lost Collector’s Club, Dewar’s Aberfeldy Distillery will re-issue a replacement Collector’s Club card. Dewar’s Aberfeldy Distillery are entitled to use your details to contact you in relation to service information including, but not being limited to, information about changes to these Terms and Conditions of use, expiry and/or renewal reminders. Dewar’s Aberfeldy Distillery will not use your details for marketing purposes unless you opted in to receive such information at the time of signing up to the Collector’s Club. Dewar’s Aberfeldy Distillery is entitled, in its absolute discretion, to add or remove tiers and at any time and for any reason and change the benefits and perks offered in the Dewar’s Aberfeldy Distillery Collector’s Club. Dewar’s Aberfeldy Distillery reserves the right to vary these Terms and Conditions by giving you no less than 30 days written notice of such variation. You can join the Dewar’s Aberfeldy Distillery Collector’s Club Adventurer tier free of charge.

OUR LIABILITY

If you suffer losses as a result of Dewar’s Aberfeldy Distillery breaking these conditions, our liability is strictly limited to the purchase price of the loyalty card you purchased. We are not responsible for any loss of profit, loss of business, loss of goodwill, or any indirect, special or consequential loss, damage, costs, expenses or other claims which arise out of in connection with the Collector’s Club. Notwithstanding the foregoing, nothing in these terms’ limits in any way our liability:

  • For death or personal injury caused by our negligence;
  • Under section 2(3) of the Consumer Protection Act 1987;
  • For fraud or fraudulent misrepresentation; or
  • For any matter which cannot be excluded by law.

EVENTS OUTSIDE OF OUR CONTROL

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these terms and conditions that is caused by events outside our reasonable control (“Force Majeure Event”). Our performance under these terms and conditions is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under these terms and conditions may be performed despite the Force Majeure Event.
